Those of us who own FRED have thus far refrained from public comment about the lawsuit we filed against Martin Wallace on July 20, 2009. However, we have now reached the point where we can no longer be silent. We can no longer tolerate the fact that Martin Wallace can behave as he has, for both the past seven weeks with regard to the lawsuit, and for the past four years with regard to the contract with Eagle that he signed in 2005, and yet continue to get significant sympathy while FRED continues to get significant backlash.
We have believed for some time now that an amicable agreement, expeditiously reached, would be in everyone’s best interest. And yet all overtures we make to Wallace, and every offer of settlement we propose, continue to be met with unreasonable responses, inappropriate public disclosures and/or false statements.
We hope the greater game-playing community will be able to tell, after reading all of the documents we have posted herein, that we are and always have been willing to reach a reasonable settlement of our differences with Martin Wallace.
FRED remains willing to submit to mediation, or arbitration, though Wallace has soundly rejected this idea. Perhaps an “impartial” panel (somehow nominated and selected from BGG and BGN readers) could be involved in that mediation? Many of you certainly seem to have outspoken opinions about the issues. It is quite obvious that trying to work through the legal/court system will prove to be so expensive and time-consuming that everyone will lose (except the lawyers). Yet nothing else to date has managed to get Martin Wallace’s attention focused on resolving the issues.
